1. The Service

Soul Garden is a personal-reflection companion that uses astrology, tarot, and AI-generated insights as tools for self-exploration. The content generated by our AI personas (Solivia, Cosmica, Fatima, and others) is for entertainment and personal reflection only. It does not constitute professional advice of any kind — including but not limited to medical, psychological, legal, or financial advice. Always consult a qualified professional for serious life decisions.

2. Artificial Intelligence & Automated Processing

You will interact with AI-powered chat personas. These are language models — they are not human, and they do not have genuine feelings, opinions, or consciousness. At the start of every new chat, we disclose this explicitly in accordance with Article 50 of the EU AI Act.

During onboarding, we use your birth data, selected belief system, and life-focus preferences to automatically generate a personalised AI companion profile ('AI Persona'). This is an automated decision. You may request a human review of your AI Persona at any time by contacting us at soulgarden.mira@gmail.com.

3. Eligibility

You must be at least 16 years old to create an account. By registering, you confirm that you meet this requirement. We do not knowingly collect data from children under 16. If we learn that an account belongs to someone under 16 we will delete it promptly.

4. Your Account

You are responsible for keeping your credentials secure. Notify us immediately at soulgarden.mira@gmail.com if you suspect unauthorised access. We may suspend or terminate accounts that violate these Terms, engage in fraud, or are inactive for more than 24 months.

5. Sensitive Personal Data (GDPR Art. 9)

Some features of Soul Garden involve data that may be classified as 'special category' under GDPR Article 9 — specifically data relating to philosophical or religious beliefs (your selected belief system and spiritual practices). You give explicit consent to process this data when you tick the special-category consent checkbox at registration. You may withdraw this consent at any time by deleting your account or contacting us. Withdrawal does not affect the lawfulness of processing before withdrawal.

6. Payments & Subscriptions

Premium features are available via subscription. Payments are processed by Stripe, Inc. under their Terms of Service. Subscriptions renew automatically unless cancelled before the renewal date. You may cancel any time from your account settings. Refunds are granted in accordance with applicable consumer protection law (including the EU Consumer Rights Directive). EU consumers have a 14-day right of withdrawal from the date of subscription confirmation (EU Consumer Rights Directive 2011/83/EU, Art. 9). If you access premium features during that period, you expressly request immediate delivery and acknowledge that exercising the right of withdrawal is not possible once the digital content has been fully delivered. To withdraw before first access, contact soulgarden.mira@gmail.com within 14 days of subscribing.

7. Intellectual Property

All content, design, and software in Soul Garden is owned by or licensed to Eventure / Soul Garden and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission. Content you generate (your chat messages, journal entries) remains yours; you grant us a limited licence to process it to deliver the service.

8. Prohibited Use

• Scraping or automating requests to our service
• Attempting to reverse-engineer, decompile, or extract model weights or prompts
• Using the service to generate content that is harmful, hateful, or illegal
• Impersonating another person or entity
• Sharing your account credentials with third parties

9. Disclaimer of Warranties

The service is provided 'as is' and 'as available'. We make no warranties — express or implied — regarding accuracy, completeness, or fitness for a particular purpose. Astrology and tarot are interpretive arts; AI readings are probabilistic and may be incorrect.

10. Limitation of Liability

To the fullest extent permitted by law, Soul Garden and its team shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater. Nothing in these Terms limits liability for death, personal injury, or fraud.

11. Account Termination

You may delete your account at any time from Settings → Support → Delete Account. We will erase your personal data within 30 days. We retain anonymised analytics and backup data for up to 90 days as required by our security obligations.

12. Changes to These Terms

We may update these Terms to reflect product changes or legal requirements. We will notify you by email or in-app notification at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.

13. Governing Law & Disputes

These Terms are governed by the laws of the European Union and the jurisdiction in which Eventure is incorporated. For EU consumers, mandatory statutory rights under applicable consumer protection law always apply and are not restricted by these Terms. We encourage you to contact us first to resolve any dispute informally.
